Agreement reached to fill CO positions at some institutions

Future talks scheduled to deal with non-COs and CO positions at other institutions

Two agreements reached on Monday June 16, 2003 between OPSEU and MPSS identify over 200 classified Correctional Officer positions to be filled at several institutions before July 31, 2003.

There will be no competitions for these positions. Instead, positions will be filled on the basis of seniority pursuant to Appendix 24. The classified CO positions will be offered first to the most senior unclassified Correctional Officers until the positions are filled. Seniority will be calculated based on straight time hours worked from the beginning of the unclassified employee’s service up to and including Nov. 10, 2002.

“This is the first test of what Appendix 24 means, and what it means is real seniority for unclassified employees in correctional institutions,” commented Barry Scanlon, Chair of OPSEU’s Ministry Enforcement and Renewal Committee for MPSS.

NOTE: These agreements do not cover all positions or all institutions. Talks are scheduled for the near future to deal with non-COs and CO positions at other institutions.

Each institution listed in the agreements has the number of available positions for that institution attached, and an identified group of Correctional Officers who can access those positions on the basis of seniority.

Several institutions have two sets of available positions. The first set has been identified for Correctional Officers at that site only; the second set allows a second institution to access the positions on the basis of seniority through a dovetailed (combined) seniority list for both institutions. As a result, some unclassified employees who have many years of service but have had limited or no access to positions due to redeployment into their institution or layoffs (or both) will now have an opportunity at a position at another facility, provided they have enough seniority.

The agreements address Correctional Officer positions at most decommissioning/ decommissioned institutions, as well as some institutions not slated for closure.

Examples

An example of what will occur at a facility that has already closed is GATU in Guelph.

· Unclassified Correctional Officers at GATU (who were employed at the institution on Nov. 10, 2002 and continued to be employed as OPS Correctional Officers on May 22, 2003) will be ranked in order of seniority as calculated according to Appendix 24.

· GATU has nine (9) available positions. The most senior unclassified CO at GATU will be offered a classified position and so on down the seniority list until all nine (9) positions are filled.

· The nine (9) newly classified COs receive their Article 20 rights from the Guelph (GATU) location.

An example of what will occur at a facility that is not slated for closure is Toronto West Detention Centre.

· Unclassified Correctional Officers at Toronto West (who were employed at the institution on Nov. 10, 2002 and continued to be employed as OPS Correctional Officers on May 22, 2003) will be ranked in order of seniority as calculated according to Appendix 24.

· Toronto West has twenty-seven (27) available positions in its first set. The most senior unclassified CO at Toronto West will be offered a classified position and so on down the seniority list until all twenty-seven (27) positions are filled.

· The twenty-seven (27) newly classified COs remain at Toronto West as classified Correctional Officers.

· Toronto West has eight (8) available positions in its second set. An unclassified seniority list containing the unclassified Correctional Officers at Toronto West who have not been offered one of the twenty (27) positions will be dovetailed with the seniority list of unclassified Correctional Officers from Maplehurst Complex (who were employed at Maplehurst Complex on Nov. 10, 2002 and continued to be employed as OPS Correctional Officers on May 22, 2003).

· The most senior unclassified CO on the combined seniority list will be offered a classified position and so on down the seniority list until all eight (8) positions are filled.

· The eight (8) newly classified COs remain at Toronto West as classified Correctional Officers.
